Welcome to Booker Auction Company. By registering for and participating in our online auctions, you agree to the following Terms & Conditions. Please read them carefully before bidding.


1. Registration & Payment Authorization

By registering, creating an account, or placing a bid, you agree to transact electronically and accept these Terms as a binding agreement under the Uniform Electronic Transactions Act.

By registering:

  • You authorize a $250 temporary hold on your credit card for each auction

  • You authorize Booker Auction Company to store your payment credentials and charge your card on file for any purchases, buyer’s premiums, taxes, fees, shipping, storage, late charges, or unpaid balances (the “Total Purchase Price”)

  • You authorize such charges without further notice after payment deadlines have passed

  • You represent that you are the authorized cardholder and that all provided information is accurate

This hold is not a charge and will be released if no purchases are made. Timing depends on your card issuer.
Payment information is processed securely and is not stored in a viewable format.

2. Buyer’s Premium

A Buyer’s Premium is added to each purchase:

  • 10% for items $1 – $5,000

  • 5% for items $5,001 – $50,000

  • 2.5% for items $50,001 and above

You acknowledge this premium is part of the Total Purchase Price and is agreed to when placing a bid.

3. Payment Terms

  • Payment is due within 48 hours of auction close

  • A 3% credit card processing fee applies to all credit card transactions

  • Processing fees are non-refundable

  • Invoices of $300 or less will be automatically charged

If payment is not received within 48 hours:

  • Your card on file may be automatically charged without further notice

  • A 2% late fee may be added

  • Additional reasonable collection or administrative costs may be applied where permitted by law

You agree that all such charges are authorized and consistent with these Terms.

Debit cards are accepted in person only at 31 Eltopia W Rd., Eltopia, WA.

4. Sales Tax (Washington State)

Sales tax will be applied in accordance with Washington State law unless noted Tax Exempt in the lot description or a valid exemption is provided.

  • Exemption documents must be submitted within 48 hours

  • No refunds for sales tax will be issued after payment is completed

  • Please Note: Not all items qualify for tax exemptions

Nothing in this section limits your rights under the Washington Consumer Protection Act.

5. Accepted Payment Methods

We accept:

  • Online payments via invoice

  • Electronic checks (ACH)

  • Checks

  • Credit cards

  • Wire transfer

  • In-person payments at 31 Eltopia W. Rd., Eltopia, WA

New bidders may be asked to provide financial references or identity verification.

6. Title, Registration & Document Service Fees (Washington State)

For titled items (including vehicles, trailers, and equipment), the following apply:

  • All bidders must register with a valid government-issued photo ID for any purchase involving titled assets

  • A Document Service Fee of $200.00 will be charged for processing title and registration paperwork

  • This fee is negotiable as required under Washington State law, but must be requested prior to payment

  • The fee reflects administrative processing, compliance handling, and document preparation

  • If payment is completed without requesting adjustment, buyer accepts the fee as charged

In addition:

  • Buyers are responsible for all title, registration, licensing, filing, and transfer fees required by the Washington State Department of Licensing

  • These government fees are not controlled by Booker Auction Company and may change without notice

Title Processing Terms

  • Titles will not be processed or released until all funds have cleared

  • Buyer must provide all required documentation and signatures promptly

  • Delays caused by buyer inaction or incomplete paperwork may result in additional administrative or storage fees

Processing Delays & Liability

  • Booker Auction Company is not responsible for delays caused by third parties, including the Washington State Department of Licensing, postal services, financial institutions, or prior lienholders

  • Processing times are estimates only and not guaranteed

  • Title delays are not grounds for cancellation, refund, or chargeback

Out-of-State Buyers

  • Buyers are responsible for compliance with their home state requirements

  • No guarantee is made regarding acceptance of Washington-issued documentation outside the state

7. Item Condition & Inspection

All items are sold “AS IS, WHERE IS, WITH ALL FAULTS.”

  • Booker Auction Company does not perform inspections, testing, or verification of items prior to sale

  • Any descriptions, photos, or statements are provided as a convenience only and may be based on third-party or consignor information

  • No guarantees are made regarding condition, authenticity, safety, operability, merchantability, or fitness for a particular purpose

  • No returns, refunds, or exchanges except as required by law

  • Announcements made during the auction take precedence over prior descriptions

Bidder assumes full responsibility for evaluating items prior to bidding, whether or not an inspection opportunity is provided.

8. Ownership & Responsibility

Once an item is declared sold:

  • A legally binding contract is formed

  • Ownership transfers immediately upon full payment

  • Risk of loss transfers upon release to buyer or delivery to carrier

  • Items cannot be removed until full payment is received

Carrier confirmation, shipping records, or pickup documentation may be used as proof of delivery in any dispute.

9. Storage & Removal Policy

Removal Deadlines
All items must be removed by the stated deadline.

  • Storage fees begin immediately after the deadline

  • Items will not be released until all balances are paid

Miscellaneous Items
Items not removed within 30 days may be considered abandoned unless prior arrangements are approved.

Titled Items

  • $100 per week storage fee

  • Continues until removal

Lien Rights (Washington State)

In accordance with Washington law, Booker Auction Company maintains a lien on all items for unpaid balances, including purchases, storage fees, and related charges. Items will not be released until paid in full.

Abandoned Property / Resale

Unremoved or delinquent items may be resold or disposed of.

By participating, you agree:

  • Ownership of abandoned items is forfeited

  • You remain liable for any deficiency after resale

  • Proceeds may be applied to outstanding balances, fees, and costs

10. Loading & Transportation

Buyers are solely responsible for all aspects of removal, including:

  • Labor, equipment, and tools required

  • Safe loading and securing of items

  • Compliance with all safety laws and transportation regulations

Booker Auction Company:

  • Does not provide guaranteed assistance, equipment, or personnel

  • Makes no representations regarding weight, dimensions, or handling requirements

  • May refuse unsafe loading practices at its sole discretion

You assume all risk of injury, damage, or loss during removal and transport.

You expressly release Booker Auction Company from all liability related to:

  • Personal injury or death

  • Property damage

  • Equipment failure

  • Improper loading or transport

11. Limitation of Liability

To the fullest extent permitted by Washington law:

  • Booker Auction Company shall not be liable for any indirect, incidental, consequential, or punitive damages, including loss of profits or business interruption

  • Total liability, if any, shall not exceed the purchase price actually paid for the item in dispute

This limitation applies regardless of claim type, including contract, negligence, or otherwise.

12. Indemnification

You agree to defend, indemnify, and hold harmless Booker Auction Company and its affiliates from any claims, damages, losses, or expenses (including attorney fees) arising from:

  • Your participation in the auction

  • Your breach of these Terms

  • Your failure to safely remove or use purchased items

  • Any injury or damage caused by items after purchase

This obligation survives completion of the transaction.

13. Auctioneer Rights

Booker Auction Company reserves the right to:

  • Deny, suspend, or revoke bidding privileges at any time

  • Require deposits or additional verification

  • Withdraw, re-catalog, or re-offer items

  • Resolve bidding disputes at its sole discretion

  • Reject or nullify bids suspected of fraud, error, or system malfunction

The auctioneer’s decisions are final.

14. Technical Issues

Booker Auction Company does not guarantee uninterrupted or error-free operation of its platform.

We are not responsible for:

  • Missed bids due to connectivity issues

  • System delays or failures

  • Software or third-party platform errors

In the event of technical issues, Booker Auction Company reserves the right to:

  • Extend, suspend, or restart bidding

  • Cancel affected lots or auctions

  • Reopen bidding at its discretion

Bidder acknowledges that online bidding involves inherent technological risk.

15. Chargebacks & Payment Disputes

You agree to contact Booker Auction Company to resolve any issue before initiating a chargeback.

You acknowledge:

  • Bids are binding and authorized transactions

  • Charges consistent with these Terms are authorized

  • Initiating a chargeback on a valid charge may constitute breach of this agreement

To the extent permitted by law, you agree to reimburse Booker Auction Company for reasonable, documented costs resulting from improper chargebacks, including administrative and collection expenses.

This section does not limit your rights under applicable law.

16. Records & Evidence

You agree that Booker Auction Company’s records—including:

  • Bid history

  • IP logs

  • Timestamps

  • Invoices

  • Communications

constitute valid evidence of authorization and transaction activity in any dispute.

17. Governing Law

These Terms are governed by the laws of the State of Washington.
Any disputes shall be handled in Washington courts.

18. Privacy

Your information is used for:

  • Registration and verification

  • Payment processing

  • Fraud prevention

We do not sell your data.

19. Severability

If any provision is deemed unenforceable, it shall be modified to the minimum extent necessary to remain enforceable, and all remaining provisions shall remain in effect.

20. Agreement to Terms

By registering, bidding, or purchasing, you confirm that you:

  • Have read and understood these Terms

  • Agree to be legally bound by them

  • Authorize all charges consistent with these Terms

  • Accept updates announced prior to or during the auction
